Banks County is situated in the northeastern part of the United States state of Georgia. The county seat is Homer. This County is the state’s 129th county and had a population of 18035 according to the 2020 census. The Georgia General Assembly passed the law establishing Banks County on December 11, 1858. Mainly, this legislation called for the creation of the County on February 1959 from Habersham and Franklin Counties. It was named after Richard E. Banks, a circuit-riding surgeon who treated white settlers and Indians in this area. He gradually developed a good reputation among the Cherokees for smallpox treatment.  

The County has a total area of 234 square miles comprising 232 square miles in land and 1.8 square miles in water. It is entirely situated in the Broad River sub-basin of the Savannah River basin. The first courthouse was constructed in 1863, and in 1980 it was placed on the National Register of Historic Places.  

Banks County Sheriff’s Office 

The Banks County Office of the Sheriff is a constitutional office holding exclusive powers and authority. Typically, it is more than any other department of the county government since the operations are the sole responsibility of the Sheriff and not the local county government. The Sheriff’s Office derives its authority and powers from the constitution and the citizens who elected the Sheriff. The Sheriff is not an employee or a subordinate of a county administrator or the county commission. In this County, there are specific duties of the Sheriff, according to O.C.G.A. § 15-16-10, including: 

  • Attend all sessions of the Superior Court  
  • Execute and return orders and processes of the court 
  • Receive all unexecuted writs and processes from the preceding Sheriff  
  • Develop and implement a detailed plan for the security of the courthouse and any annex 
  • Maintain a record of all sales made by process of court 
  • Publish sales, citations, and other proceedings as required by law 
  • Attend election sites

Courthouse  

The law mandates the Sheriff to have a detailed plan for the security of the courthouse and all courthouse annexes. Notably, the Chief Judge must approve this plan and review it every four years. The Sheriff is responsible for maintaining the court’s and courthouse’s security and safety. Apart from providing security, the Sheriff or his Deputy serves the as the bailiff of the Superior court and the probate court upon request. In this role, the Sheriff helps maintain order and decorum in the courtroom and provides protection and security for jury members and proceedings.  

Additionally, this Office is tasked with serving most of the civil process papers and summonses.

Under their Office, the Sheriff of Banks County is the official jailor of the area. He is responsible for the health, welfare, and safety of the offenders under his custody. Additionally, the Sheriff is also in charge of protecting the rights of these inmates.
